BrandRocketMedia, registered at 75016, 50 rue Molitor, Paris, France ("we", "us", "our"), is committed to protecting your personal data in compliance with Regulation (EU) 2016/679 (General Data Protection Regulation — "GDPR").
1. Data Controller. The data controller is BrandRocketMedia, reachable at [email protected]. For any data protection requests, please contact us at this address.
2. Data Collected. We collect the following personal data through our contact forms: full name, email address, phone number (optional), company name (optional), service interest selection, and free-text project details. We do not collect special category data, financial data, or data from minors under 16.
3. Purpose & Legal Basis. Your data is processed under Article 6(1)(b) GDPR (performance of a contract or pre-contractual measures) for the purpose of responding to inquiries and delivering requested services. We also rely on Article 6(1)(f) (legitimate interest) for internal record-keeping and service improvement.
4. Data Sharing. We do not sell, rent, or share personal data with third-party data brokers. Data may be shared with our hosting provider (EU-based), email service provider, and accounting software — all acting as data processors under written Data Processing Agreements (DPAs).
5. Retention. Contact form data is retained for a maximum of 24 months from the last interaction. Project-related data is retained for the duration required by applicable tax and commercial law (typically 5–10 years for invoices).
6. International Transfers. All personal data is stored within the European Economic Area (EEA). Should any transfer outside the EEA become necessary, we will ensure adequate safeguards (Standard Contractual Clauses) are in place.
7. Your Rights. Under GDPR, you have the right to access, rectify, erase ("right to be forgotten"), restrict processing, object to processing, and port your data. You may also lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL) at https://www.cnil.fr.
8. Security. We implement appropriate technical and organizational measures including encryption at rest and in transit, access controls, and regular security reviews to protect your personal data.
Terms of Service
Effective Date: September 2026
What we offer: Web design and digital experience services as described in individual project proposals.
Payment terms: 50% deposit to start, 50% upon delivery. Invoices are due within 14 days.
Ownership: Once fully paid, you own everything we build for you — code, designs, and assets.
Revisions: Each project includes up to 2 rounds of revisions. Additional rounds are billed at our standard hourly rate.
Cancellations: You may cancel before work begins for a full refund. Partial work completed is billable.
These Terms of Service ("Terms") govern all engagements between BrandRocketMedia, 75016, 50 rue Molitor, Paris, France ("Service Provider") and any individual or entity ("Client") that engages our services.
1. Scope of Services. Services are defined in individual Statements of Work ("SOW") or project proposals issued by BrandRocketMedia. Each SOW specifies deliverables, timelines, pricing, and revision allowances. These Terms apply to all SOWs unless explicitly overridden in writing.
2. Pricing & Payment. All prices are quoted in USD unless otherwise specified. A 50% deposit is required before work commences. The remaining 50% is invoiced upon delivery and due within 14 calendar days. Late payments accrue interest at 1.5% per month. All prices are exclusive of applicable taxes (e.g., French VAT).
3. Intellectual Property. Upon full payment of all outstanding invoices, BrandRocketMedia assigns all worldwide intellectual property rights in the deliverables to the Client. This includes source code, design files, graphic assets, and documentation. Pre-existing tools, frameworks, and libraries used in delivery remain the property of their respective owners and are licensed to the Client in perpetuity.
4. Revisions. Each project includes up to two (2) rounds of revisions at no additional cost. Additional revision rounds are billed at €95/hour. Revisions requested after client sign-off of a milestone are treated as new change requests and quoted separately.
5. Cancellation & Termination. The Client may cancel at any time prior to commencement of work for a full deposit refund. Once work has begun, the deposit is non-refundable and any completed work is billable. Either party may terminate with 14 days' written notice. BrandRocketMedia reserves the right to terminate immediately if the Client breaches these Terms.
6. Limitation of Liability. BrandRocketMedia's total liability under any SOW shall not exceed the total fees paid by the Client for that project. We shall not be liable for indirect, incidental, or consequential damages. We are not responsible for losses caused by third-party services, hosting outages, or force majeure events.
7. Confidentiality. Both parties agree to keep confidential any proprietary information shared during the engagement. This obligation survives termination for a period of three (3) years.
8. Governing Law. These Terms are governed by the laws of France. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Paris, France.
Refund Policy
Effective Date: September 2026
Before work starts: Full refund of your deposit if you cancel before we begin.
During the project: The deposit is non-refundable. Completed milestones are billable.
After delivery: If deliverables don't match the agreed SOW, we'll fix them at no cost.
Refund timeline: Approved refunds are processed within 10 business days.
BrandRocketMedia operates a fair and transparent refund policy in accordance with French consumer protection law and applicable EU directives.
1. Pre-Commencement Cancellation. If the Client cancels a project before any work has commenced, the full deposit will be refunded within 10 business days. "Commencement" is defined as the first billable hour of design or development work.
2. Mid-Project Cancellation. If the Client cancels after work has commenced, the deposit is non-refundable. Any completed milestones that have been delivered to the Client are billable at the rates specified in the SOW. No refund will be issued for work in progress.
3. Post-Delivery Disputes. If the delivered work materially deviates from the specifications agreed in the SOW, the Client must notify BrandRocketMedia in writing within 14 calendar days of delivery. BrandRocketMedia will, at its discretion, either remedy the deviations at no additional cost or issue a partial refund proportional to the scope of the deviation.
4. Refund Process. All refund requests must be submitted in writing to [email protected]. Approved refunds will be processed to the original payment method within 10 business days. BrandRocketMedia reserves the right to deduct administrative fees (maximum 5%) for refunds involving third-party payment processing costs.
5. Non-Refundable Items. Domain registration fees, third-party license fees, and hosting prepayments are non-refundable once incurred on behalf of the Client.
6. Dispute Resolution. Any disputes arising from refund requests shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the mediation service of the Paris Commercial Court before any judicial proceedings.
